“Our purpose is not to shame the employers but to help them comply with their obligations and to ensure that our employees can get the benefits from their SSS contributions.”
This was stressed by Atty. Renato Jacinto S. Cuisia, Social Security System acting Vice President for Operations Legal Services Division I and II, during the Run After Contribution Evaders (RACE) operation held in Albay on July 30.
“SSS Legazpi branch revealed that out of the 5,040 active employer accounts, about 68 % or more than 3,400 employers were non-compliant. That’s why we immediately scheduled RACE operations here in Legazpi to remind delinquent employers to settle their obligations to SSS,” Cuisia said.
Cuisia led the team of national and regional SSS officials to visit ten non-compliant employers due to non-remittance and/or non-production of employment records.
During the operations, Show Cause Orders were posted at KDVM Grilling Point (De Oro BBQ King), Almiñe Glass and Aluminum Center, Sampaguita Tourist Inn, Funeraria Oro, Junzon’s Commercial, DE FEDBAC Corp, Family Kitchenette, YCS Restaurant & Catering Service (Ysabelle’s), La Granja Boutique Hotel Corp., and Casablanca Management Group Co.
Non-compliant employers subjected to the operations are compelled to reply to the show cause order within a non-extendable period of 15 days from posting of the order to their establishment. If they fail to respond within the given period, SSS will take legal action against them.
“Employers who were proven to have violated the SS Law shall be sentenced to a maximum of 12 years imprisonment. Aside from this, the court will also require them to settle the total amount of delinquencies and pay penalties,” said Cuisia.
SSS Penalty Condonation Program
The SSS official also reminded all delinquent employers, including those employers who were subjected to the RACE Campaign, to avail of the ongoing Contribution Penalty Condonation Program until September 6, 2019.
“We understand that most of our employers are currently experiencing financial distress that’s why we are offering this special program for them to conveniently settle their contribution delinquencies without paying the accumulated penalties,” said Cuisia.
This program allows employers with unpaid contributions to settle and waive their penalties.
Relieved and thankful employees
Employees of the visited establishments expressed relief and gratitude for SSS concern on their plight.
“We are thankful that SSS is concerned of our welfare and benefits. At least with this visit, our contributions will be updated for us to avail assistance especially in cases when there will be an accident or we might get sick,” an employee of Casablanca Management said.
‘Our company has been deducting contributions from us. We’re really wondering why it’s not posted. We’ve told our management about it but it seems there’s no action on their part. It’s good that SSS came and visited us,” another employee of a non-compliant establishment said.
RACE Legazpi is part of the 5th simultaneous operations on July 30. Other areas in Luzon that were visited by the RACE Team were Tuguegarao, Cagayan; and San Pablo, Laguna.
